Rilis ini menyoroti adanya dugaan ketidaksesuaian prosedur dalam proses eksekusi objek jaminan fidusia dan penolakan itikad baik pembayaran.

Dalam suratnya, ACC menyatakan menghargai “itikad baik” konsumen. Namun, fakta di lapangan menunjukkan hal sebaliknya. Konsumen melaporkan bahwa saat mendatangi kantor ACC untuk melakukan kewajiban pembayaran (tunggakan berjalan 3 bulan), pihak leasing diduga melakukan penolakan pembayaran. Secara hukum, penolakan ini dapat dianggap sebagai hambatan yang sengaja diciptakan agar debitur tetap berada dalam status Wanprestasi, yang kemudian digunakan sebagai pintu masuk untuk melakukan lelang sepihak.

Terdapat dugaan kuat pelanggaran prosedur eksekusi. Unit kendaraan (Toyota Agya R 1695 MN) diketahui dieksekusi saat sedang berada di tangan pihak lain tanpa adanya pemberitahuan resmi (notifikasi) terlebih dahulu kepada debitur atas nama (Ibu Ani Furwanti).
Berdasarkan Putusan MK No. 18/PUU-XVII/2019, eksekusi jaminan fidusia tidak boleh dilakukan secara paksa tanpa kesepakatan cedera janji atau melalui penetapan pengadilan.
Tindakan mengambil unit tanpa koordinasi dengan pemilik sah merupakan bentuk pelanggaran hak konsumen yang serius.

Keputusan sepihak ini terkesan menutup ruang mediasi yang seharusnya dikedepankan sesuai prinsip perlindungan konsumen yang diawasi oleh OJK.
