“Sepanjang masyarakat hukum adat dan tanah ulayatnya masih ada, negara mengakui, menghormati, dan melindunginya. Melalui pengadministrasian dan pendaftaran tanah ulayat, kita ingin memberikan kepastian hukum sehingga hak masyarakat adat tetap terlindungi,” ujar Staf Ahli Bidang Hukum Agraria dan Masyarakat Adat, Slameto Dwi Martono, dalam acara Sosialisasi Pengadministrasian dan Pendaftaran Tanah Ulayat di Kabupaten Buton, Kamis (02/07/2026).
Menurut Slameto Dwi Martono, kuatnya sejarah adat di Kabupaten Buton menjadi modal penting dalam pelaksanaan pengadministrasian dan pendaftaran tanah ulayat. Namun, sebelum didaftarkan, perlu dipastikan terlebih dahulu bahwa masyarakat hukum adat beserta tanah ulayatnya masih eksis dan memenuhi ketentuan sebagaimana diatur dalam peraturan perundang-undangan.
“Jika masyarakat hukum adat beserta tanah ulayatnya masih memenuhi persyaratan, pengadministrasian dan pendaftaran menjadi langkah penting untuk mencegah sengketa pertanahan sekaligus memberikan perlindungan hukum yang lebih kuat. Karena itu, identifikasi harus dilakukan secara cermat agar hak masyarakat adat benar-benar terlindungi,” jelas Slameto Dwi Martono.
Ia menjelaskan, Peraturan Menteri ATR/Kepala BPN Nomor 14 Tahun 2024 memberikan pilihan kepada masyarakat hukum adat untuk melakukan pengadministrasian hingga penerbitan daftar tanah ulayat atau melanjutkannya sampai penerbitan sertipikat hak atas tanah. Pilihan tersebut diberikan sesuai kesepakatan masyarakat hukum adat sehingga tidak ada kewajiban untuk langsung melakukan sertipikasi.
Selain itu, Slameto Dwi Martono menegaskan bahwa pemberian Hak Pengelolaan atas tanah ulayat bukan berarti negara mengambil alih tanah masyarakat hukum adat. Sebaliknya, hak tersebut menjadi instrumen perlindungan agar tanah ulayat tidak mudah dialihkan maupun diperjualbelikan, sekaligus membuka peluang pemanfaatan tanah secara produktif sesuai kesepakatan masyarakat adat dan ketentuan yang berlaku.
Sosialisasi ini diikuti oleh perwakilan masyarakat hukum adat di Kabupaten Buton. Mereka aktif bertanya dan berdiskusi dalam upaya mempertahankan agar tanah ulayatnya tetap eksis. Turut memberikan materi, perwakilan dari Kementerian Kelautan dan Perikanan dan Kementerian Dalam Negeri.
