JAKARTA – WARTA JAVAINDO, Sungguh bobrok manajemen Lembaga Pemasyarakatan (LP) Kelas I Cipinang, Jakarta Timur, yang kinerjanya tidak “connect” (terhubung) dengan Direktur Jenderal Pemasyarakatan (Dirjen PAS) Kementerian Hukum dan Hak Asasi Manusia (Kemenkumham), terkait pembebasan narapidana yang telah mendapat Remisi Lansia (Lanjut Usia) yang jatuh pada setiap tanggal 29 Mei.
Mengapa tanggal 29 Mei 2024 ada Remisi Lansia! Karena tanggal 29 Mei adalah Hari Lansia sedunia, sehingga para napi lansia di LP-LP, yang memenuhi syarat, mendapat Remisi Lansia. Seharusnya mereka menerima Surat Keputusan (SK) Remisi Lansia dari Dirjen PAS dan sekaligus dibebaskan dari tahanan, Rabu (29/5/2024) lalu.
Sementara di LP Kelas I Cipinang terdapat 7 napi lansia yang seharusnya tanggal 29 Mei 2024 lalu menerima Remisi Lansia, namun tidak diberikan dengan dalih belum ada SK Dirjen PAS.
“Karena itu, ke-7 lansia (ada yang sakit permanen) itu masih ‘tersandera’ dan secara ilegal masih berada di LP Kelas I Cipinang,” kata advokat senior yang juga Koordinator Tim Pembela Demokrasi Indonesia (TPDI) Petrus Selestinus SH dalam rilisnya, Senin (3/6/2024).

Menurut Petrus, hal tersebut terkait ego sektoral yang sudah menjadi budaya kerja, dan diduga ada permainan oleh aparat dan pejabat di bawahnya, sebagai bagian dari budaya kerja yang tidak profesional, sehingga terjadi maladministrasi yang sangat merugikan HAM para napi lansia yang mungkin jumlahnya sangat banyak di seluruh LP di Indonesia.
“Keluarga dari 7 napi lansia itu tentu sangat kecewa, dan merasa tidak masuk akal sehat, kalau benar Kepala LP beralasan belum ada SK Dirjen PAS. Dengan demikian, hal ini telah mencoreng wajah HAM Indonesia, wajah Menteri Hukum dan HAM Yasonna Laoly dan wajah hukum Indonesia,” sedapnya sambil mendesak agar Yasonna segera bertindak.
Sesuai Peraturan Menkumham No 7 Tahun 2022 yang mengatur tentang Remisi Lansia, kata Petrus, maka SK Dirjen PAS tentang Remisi Lansia itu seharusnya sudah diterbitkan di Hari Lansia Sedunia tanggal 29 Mei 2024. “Dan ini diduga disengaja oleh Petugas LP dengan motif tertentu, termasuk uang,” cetusnya.
Kepala LP Kelas I Cipinang, lanjut Petrus, seharusnya tahu soal pembebasan tahanan napi lansia, kaitannya dengan HAM dan rasa kemanusiaan. “Karena itu, jika hak mereka yang dijamin oleh peraturan perundang-undangan dikangkangi, maka ini adalah pelanggaran HAM sehingga Menteri Hukum dan HAM harus bertanggung jawab,” tegasnya.
Oleh karena itu, kata Petrus, Yasonna Laoly harus menindak Dirjen PAS dan Kalapas Kelas I Cipinang akibat salah urus atau maladministrasi yang sangat merugikan hak napi lansia,” tandasnya.
