Mantan Sekdes Cendono Ditetapkan  Sebagai Tersangka Kasus Tindak Pidana Korupsi Penjualan Tanah

KUDUS – WARTA JAVAINDO, (13/05/24). Mantan Sekretaris Desa (Sekdes) Cendono, Dawe Kudus FR (58), setelah ditetapkan sebagai tersangka dan berkas perkara dinyatakan lengkap (P.21) oleh Kejaksaan Negeri Kudus kini memasuki kegiatan Tahap II (pelimpahan tersangka dan barang bukti ) atas kasus dugaan tindak pidana korupsi penjualan Tanah Kas Desa pada tahun 2005,2009,2010,20212 dan 2014.

Kapolres Kudus, AKBP Dydit Dwi Susanto melalui Wakapolres,  Kompol Satya Adi Nugraha menjelaskan, FR menjadi tersangka setelah polisi mengusut dugaan kasus korupsi saat menjabat Sekdes Cendono dengan menjual enam bidang Tanah Kas Desa Cendono yang hasilnya untuk kepentingan pribadi.

Polisi juga menggeledah Kantor Desa Cendono dan rumah tersangka di wilayah Kecamatan Dawe Kudus.

Hasil penggeledahan, polisi menyita barang bukti sejumlah dokumen, antara lain 1 berkas Persetujuan Penetapan Keputusan Kepala Desa Cendono tentang Tukar menukar Sebagian Tanah Kas Desa Cendono untuk pengembangan usaha atas nama : Tas’an Wartono, 1 berkas tanda terima penyerahan 42 SHM a.n Tas’an Wartono kepada FR tanggal 13 Januari 2004, 1 berkas kuintansi penyerahan uang pembayaran tanah dari Sholicin (pembeli) kepada FR sebesar Rp.70.000.000,- dan 1 berkas salinan warkah SHM atas nama pembeli.

“Penyidik melakukan serangkaian proses penyidikan dan telah ditemukan lebih dari dua alat bukti yang sah,”ungkap Kompol Satya Adi Nugraha, Senin (13/5/2024).

Tersangka FR disangkakan Pasal 2 ayat 1 juncto Pasal 3 juncto Pasal 8 UU RI No 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan UU RI No 20 Tahun 2001 tentang Perubahan atas UU RI No 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi.

“FR diancaman pidana maksimal 20 tahun dan denda paling banyak 1 Milyar”, tuturnya.

Sebelumnya, mantan Sekdes Cendono periode 2002-2021, FR (58), diduga menjual tanah Kas Desa Cendono, yang mana kejadian berawal pada tanggal 30 September 2003 telah dilakukan tukar menukar 12 bidang tanah Kas Desa Cendono seluas 59.900 m2 dengan 42 bidang tanah dengan SHM atas nama : Tas’an Wartono seluas 77.193 m2

Lanjut Kompol Satya, sebanyak 42 SHM atas nama : Tas’an Wartono pada tanggal 13 Januari 2004 kemudian diserahkan kepada tersangka yang saat itu menjabat Sekdes, namun sampai saat ini hanya 37 SHM yang dikuasai Pemdes Cendono sebagai asset desa, sedangkan sisanya 5 SHM dijual oleh FR kepada lima pembeli yang berkisar antara 28 Juta hingga 120 Juta dengan total 243 Juta.

Selain mendapatkan tanah pengganti 42 SHM, Pemdes Cendono juga mendapatkan ganti rugi dari Tas’an Wartono uang sebesar Rp. 600.000.000,-, dari uang tersebut dialokasikan untuk membeli 7 bidang tanah pengganti tambahan senilai Rp.199.800.000,-.

Namun pada tahun 2014 1 bidang tanah pengganti tambahan seluas 2.230 m2 masih letter C (belum bersertifikat) dijual dari Tersangka kepada Sholicin seharga Rp. 70.000.000,-.

“Para pembeli saat membeli tanah dari Tersangka tidak mengetahui jika tanah tersebut merupakan tanah milik Pemerintah Desa Cendono”, terang Wakapolres.

Penjualan tanah yang dilakukan FR, lanjut Kompol Satya, baru diketahui Pj Kepala Desa Cendono, Sutahar pada tahun 2021 mengajukan balik nama 42 SHM atas nama : Tas’an Wartono ke Pemdes Cendono di kantor Pertanahan Kabupaten Kudus.

Kemudian dari kantor Pertanahan menemukan 5 bidang tanah tumpeng tindih (pada satu bidang obyek tanah yang sama terdapat 2 sertifikat dengan nama pemilik yang berbeda).

“Setelah ditelusuri oleh Pemdes Cendono, ternyata ada 5 bidang tanah yang dijual FR untuk kepentingan pribadi”, ujarnya.

“Berdasarkan hasil pemeriksaan investigatif dalam rangka penghitungan kerugian keuangan Negara oleh perwakilan BPKP Provinsi Jawa Tengah terdapat kerugian keuangan Negara sebesar Rp. 982.500.000,-“, tandasnya.
