LSM Gerakan Jalan Lurus Desak Kejelasan Tiga Sertifikat Tanah di Kelurahan Gisikdrono Kota Semarang

SEMARANG – Lembaga Swadaya Masyarakat (LSM) Gerakan Jalan Lurus (GJL) Kota Semarang bersama Gerakan Anti Mafia Tanah Republik Indonesia (GAMAT) Kota Semarang menyoroti persoalan tiga sertifikat hak milik (SHM) di Desa Gisik Drono, Kecamatan Genuk. Warga setempat meminta kejelasan atas status kepemilikan SHM Nomor 34, 36, dan 37 yang hingga kini dinilai belum jelas secara hukum.
Ketua LSM GJL Kota Semarang, Budi Priyono, mengatakan bahwa pihaknya bersama warga telah berupaya meminta penjelasan dari Herman, yang mengaku sebagai pemilik ketiga sertifikat tersebut. Namun, Herman belum dapat menunjukkan dokumen resmi yang menguatkan klaim kepemilikan itu.
“Saudara Herman hanya bisa menunjukkan dokumen berupa PPJB (Perjanjian Pengikatan Jual Beli). Padahal, PPJB bukanlah bukti sah kepemilikan karena belum ditindaklanjuti dengan Akta Jual Beli (AJB),” jelas Budi saat ditemui, Jumat (10/10/2025).
Menurutnya, kejelasan status tanah tersebut penting agar tidak menimbulkan konflik atau kesalahpahaman di masyarakat. Ia juga meminta agar pihak penjual atau ahli waris dari pemilik tanah sebelumnya dapat dihadirkan untuk memberikan keterangan.
“Kami hanya ingin semuanya terbuka. Kalau memang ada AJB dan proses jual beli sah, silakan tunjukkan. Kalau belum, jangan ada klaim sepihak,” tegas Budi.
Sementara itu, Kepala Seksi Pengendalian dan Penanganan Sengketa BPN Kota Semarang, Donny Agus Kurniawan, S.H., membenarkan bahwa dokumen PPJB tidak dapat dijadikan dasar hukum kepemilikan tanah. Ia menegaskan, PPJB hanya merupakan perjanjian awal antara penjual dan pembeli, bukan bukti sah kepemilikan.
“PPJB belum bisa dikatakan sebagai bukti kepemilikan yang sah, dan juga belum dapat dijadikan syarat administrasi untuk proses balik nama sertifikat. Dasar kepemilikan yang sah adalah Akta Jual Beli (AJB) yang dibuat di hadapan Pejabat Pembuat Akta Tanah (PPAT),” terang Donny.
Donny juga mengimbau masyarakat agar selalu memastikan setiap transaksi jual beli tanah dilakukan sesuai prosedur hukum yang berlaku untuk menghindari sengketa di kemudian hari.
Sementara itu salah satu warga setempat mengatakan, berharap kasus sengketa tanah ini bisa cepat terselesaikan, mengingat kami sudah menempati rumah dan tanah lebih dari 40 tahun lamanya.
LSM Gerakan Jalan Lurus bersama Gerakan Anti Mafia Tanah Republik Indonesia menegaskan akan terus mengawal kasus ini hingga diperoleh kejelasan hukum dan kepastian bagi warga Desa Gisik Drono, Kota Semarang.
